This Disclaimer (“Disclaimer”) applies to your use of Pi App Studio (“AI Service”) provided by Pi Network (“Company”) for the independent drafting of code for app development by you. By using the Company’s AI Service, you agree to the terms and conditions set forth in this Disclaimer.

No Warranties

1. Disclaimer of Warranties: The AI Service provided by the Company is offered “as is” and “as available,” without any warranties of any kind, either express or implied. The Company expressly disclaims all warranties, including but not limited to:

• Merchantability: The Company does not warrant that the AI Service, or any app developed using the AI Service, will meet the standards of merchantability or that they are suitable for use, sale or trade.
• Fitness for a Particular Purpose: The Company makes no warranty that the AI Service, or any app developed using the AI Service, will be fit for any particular purpose or that they will meet your specific requirements.
• Non-Infringement: The Company does not warrant that the use of the AI Service, or any app developed using the AI Service, will not infringe on the intellectual property rights of any third party.

Limitation of Liability

2. Exclusion of Liability: To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the AI Services, or use of any app developed using the AI Service, including but not limited to:

• Loss of profits, revenue, or data;
• Business interruption;
• Costs of substitute goods or services;
• Any other damages or losses, whether in contract, tort (including negligence), or otherwise.

3. Limitation of Liability: In no event shall the Company’s total liability to you for all damages, losses, and causes of action exceed the amount paid by you, if any, for accessing the AI Service.

Indemnification

4. Indemnity: You agree to indemnify, defend, and hold harmless the Company, its affiliates and subsidiaries, and their respective officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses, including reasonable attorneys’ fees and costs, arising out of or in any way connected with your use of the AI Service, or any app developed using the AI Service.

General Provisions

5. Governing Law: This Disclaimer shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

6. Severability: If any provision of this Disclaimer is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

7. Amendments: The Company reserves the right to amend this Disclaimer at any time. Any changes will be effective immediately upon posting the revised Disclaimer.

By using the Company’s AI Service, you acknowledge that you have read, understood, and agree to be bound by this Disclaimer. If you do not agree to these terms, you should not use the AI Service.
